Welcome to The Mana College ("The Mana College," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of The Mana College website, learning platform, educational programs, courses, coaching, assessments, project activities, certificates, credentials, and related services (collectively, the "Services").

By accessing or using our website, enrolling in a course or program, participating in project work, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

1. Educational Purpose

The Mana College provides online education, professional development, leadership development, project-based learning, coaching, assessments, academic programs, and related educational services designed to support personal, professional, organizational, and societal growth.

While The Mana College designs its programs to help learners develop practical knowledge, leadership capabilities, and real-world skills, The Mana College does not guarantee any specific academic, professional, financial, employment, business, certification, licensing, or personal outcomes.

2. Eligibility

You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, to enroll in programs offered by The Mana College unless otherwise expressly permitted.

By using the Services, you represent and warrant that you have the legal authority to enter into these Terms.

3. Acceptable Use

You agree to use the Services only for lawful purposes and in a manner consistent with the educational mission and values of The Mana College.

You agree not to:

  • Violate any applicable law or regulation.

  • Harass, threaten, abuse, discriminate against, or harm others.

  • Upload or distribute unlawful, fraudulent, defamatory, offensive, or harmful content.

  • Interfere with or disrupt the operation of the Services.

  • Attempt to gain unauthorized access to any account, system, platform, or data.

  • Share account credentials with others.

  • Misrepresent your identity, academic work, project results, qualifications, or experience.

  • Submit work that is plagiarized, fabricated, or otherwise violates academic integrity requirements.

  • Use artificial intelligence, automation tools, or third-party services in a manner that violates program requirements or academic standards.

The Mana College reserves the right to suspend or terminate access to the Services for violations of these Terms or violations of academic integrity standards.

4. Enrollment and Access

Enrollment grants access only to the specific program, course, credential pathway, or services purchased or otherwise provided by The Mana College.

Unless otherwise stated at the time of enrollment:

  • Individual courses include one (1) school year of access from the date of enrollment.

  • Program access remains available for the duration specified for the applicable program.

  • Access periods may vary by course, credential, cohort, certificate, degree pathway, or other offering.

The Mana College reserves the right to modify, improve, update, replace, or discontinue course content, learning materials, assessments, faculty assignments, coaching offerings, technology platforms, and program requirements at any time.

5. Project-Based Learning

Many programs offered by The Mana College incorporate project-based learning as a core component of the educational experience.

Learners are solely responsible for:

  • Selecting appropriate project topics.

  • Obtaining organizational approvals where required.

  • Ensuring that project data is accurate and lawfully obtained.

  • Complying with confidentiality obligations.

  • Complying with applicable laws, regulations, professional standards, and organizational policies.

  • Ensuring that project recommendations are implemented appropriately.

The Mana College is not responsible for decisions made by learners, employers, clients, organizations, or third parties based upon project findings, recommendations, analyses, conclusions, or outcomes.

6. Academic Integrity

The Mana College expects learners to uphold the highest standards of honesty, integrity, responsibility, and ethical conduct.

Academic misconduct includes, but is not limited to:

  • Plagiarism.

  • Fabrication or falsification of information or data.

  • Misrepresentation of project results.

  • Unauthorized collaboration.

  • Sharing assessments, examination content, answer keys, or credentialing materials.

  • Impersonation or identity fraud.

  • Misuse of artificial intelligence tools in violation of program requirements.

The Mana College reserves the right to revoke access, academic standing, certificates, credentials, badges, transcripts, program participation, or enrollment status if academic misconduct is identified.

7. Tuition, Fees, and Payments

Tuition for programs offered by The Mana College is due in accordance with the payment terms presented at the time of admission and enrollment.

Upon acceptance into a program, learners may choose one of the following payment options:

Option 1: Full Tuition Payment

Learners may pay the full tuition amount upon receipt of the tuition invoice and prior to the applicable payment due date.

Option 2: Two-Installment Tuition Plan

Learners may elect to pay tuition in two equal installments:

  • Invoice 1: Fifty percent (50%) of the total tuition will be invoiced at the start of the school term.

  • Invoice 2: The remaining fifty percent (50%) of the total tuition will be invoiced six (6) months into the program.

Both invoices are due within sixty (60) days of the learner's receipt of the applicable invoice.

Failure to pay tuition by the applicable due dates may result in suspension of access to coursework, coaching, assessments, project reviews, academic resources, transcripts, certificates, credentials, degree pathways, or other services provided by The Mana College.

The Mana College reserves the right to withhold certificates, credentials, transcripts, graduation eligibility, and other academic recognitions until all outstanding tuition obligations have been paid in full.

The Mana College reserves the right to modify tuition rates for future cohorts, programs, and enrollments. Any tuition changes will not affect learners who have already been accepted and enrolled under a previously published tuition rate.

8. Refund Policy

Except where required by applicable law or otherwise expressly agreed to in writing by The Mana College:

All tuition payments made to The Mana College are non-refundable.

Because acceptance into a program reserves instructional, coaching, administrative, and academic resources, learners remain responsible for the full tuition obligation once accepted and enrolled, regardless of participation level, program completion, withdrawal, deferral, employment changes, personal circumstances, or other factors.

Requests involving extraordinary circumstances may be reviewed on a case-by-case basis at the sole discretion of The Mana College. Any exception granted by The Mana College shall not create an obligation to provide similar exceptions in future cases.

9. Certificates, Credentials, and Academic Recognition

Certificates, credentials, transcripts, badges, academic recognition, or similar acknowledgments are awarded only after all applicable requirements have been successfully completed and verified.

The Mana College reserves the right to:

  • Verify learner identity.

  • Review and validate submitted work.

  • Conduct audits of assignments and project submissions.

  • Require additional documentation where appropriate.

  • Revoke certificates, credentials, badges, or academic recognition obtained through fraud, misconduct, plagiarism, misrepresentation, or other violations of these Terms.

Completion of a program does not guarantee admission into any future academic program, degree pathway, professional designation, licensing process, employment opportunity, or regulatory recognition.

10. Intellectual Property

All content provided through the Services, including but not limited to:

  • Courses

  • Lectures

  • Videos

  • Audio recordings

  • Presentations

  • Assessments

  • Assignments

  • Templates

  • Exercises

  • Frameworks

  • Methodologies

  • Educational materials

  • Logos

  • Trademarks

  • Graphics

  • Software

  • Curriculum materials

  • Written content

are owned by The Mana College or its licensors and are protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified, republished, transmitted, displayed, sold, licensed, or otherwise used without prior written permission from The Mana College.

11. Learner Content and Project Submissions

You retain ownership of the original content, data, documents, and materials that you create and submit.

By submitting assignments, assessments, projects, discussion posts, reflections, presentations, or other content, you grant The Mana College a worldwide, perpetual, non-exclusive, royalty-free license to:

  • Review and evaluate submissions.

  • Maintain academic records.

  • Conduct accreditation, quality assurance, and compliance activities.

  • Use anonymized examples for educational, research, promotional, or program improvement purposes.

  • Improve learning experiences and educational offerings.

The Mana College will not publicly identify learners without permission unless required by law or otherwise authorized by the learner.

12. Suggestions and Feedback

Any suggestions, recommendations, ideas, comments, feedback, or proposed improvements submitted to The Mana College may be used without restriction or compensation.

The Mana College shall have no obligation to provide attribution, acknowledgment, or payment for submitted feedback.

13. Third-Party Services

The Services may integrate with or provide links to third-party software, educational platforms, communication tools, payment processors, artificial intelligence services, content providers, or other third-party services.

The Mana College is not responsible for the availability, accuracy, security, content, privacy practices, performance, or reliability of third-party services.

Your use of third-party services remains subject to the applicable third-party terms and conditions.

14. Privacy

The collection, storage, use, disclosure, and processing of personal information by The Mana College is governed by The Mana College Privacy Policy.

By using the Services, you acknowledge and consent to the collection and processing of information as described in the applicable Privacy Policy.

15. Disclaimers

The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by law, The Mana College disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, uninterrupted operation, and educational outcomes.

The Mana College does not guarantee:

  • Program completion.

  • Academic success.

  • Professional advancement.

  • Employment opportunities.

  • Business performance.

  • Financial results.

  • Organizational outcomes.

  • Certification, licensure, or regulatory approval.

  • Admission to future programs.

16. Limitation of Liability

To the fullest extent permitted by law, The Mana College and its officers, directors, trustees, faculty, advisors, employees, contractors, affiliates, licensors, partners, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of, or inability to use, the Services.

The total liability of The Mana College for any claim arising out of or relating to these Terms or the Services shall not exceed the total amount paid by the learner to The Mana College during the twelve (12) months preceding the event giving rise to the claim.

17. Indemnification

You agree to indemnify, defend, and hold harmless The Mana College and its affiliates, officers, directors, faculty, advisors, employees, contractors, agents, licensors, and service providers from and against any claims, damages, liabilities, losses, costs, or expenses, including reasonable attorneys' fees, arising from:

  • Your use of the Services.

  • Your violation of these Terms.

  • Your project activities or project outcomes.

  • Your violation of applicable law.

  • Your infringement of any third-party rights.

18. Suspension and Termination

The Mana College may suspend, restrict, or terminate access to the Services at any time if:

  • These Terms are violated.

  • Academic misconduct occurs.

  • Payment obligations are not satisfied.

  • Use of the Services creates legal, operational, reputational, or security concerns.

  • Continued participation is determined by The Mana College to be inconsistent with the mission, standards, or values of The Mana College.

Termination shall not affect any rights or obligations accrued prior to termination.

19. Changes to These Terms

The Mana College reserves the right to modify these Terms at any time.

Material changes will be posted on The Mana College website and become effective upon publication unless otherwise specified.

Continued use of the Services after such changes become effective constitutes acceptance of the revised Terms.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, United States, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Hawaii.

21. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

22. Entire Agreement

These Terms, together with The Mana College Privacy Policy and any additional program-specific agreements, policies, enrollment agreements, or academic requirements, constitute the entire agreement between you and The Mana College regarding the Services and supersede all prior agreements, understandings, and communications relating to the Services.
